Please read these Terms of Service carefully before using www.EventPay.com (the "Site"), including any related applications, products, or services (collectively, the "Services").

These Terms of Service ("Terms") govern your access to and use of the EventPay payment platform. By accessing or using the Site or Services, you agree to be bound by these Terms.

EventPay provides a technology and payments platform that enables users to purchase and use digital tokens at events operated by independent third-party event organizers ("Event Organizers"). Any event, festival, or gathering that uses EventPay is referred to as an "Event." Any person who accesses or uses the Services is referred to as a "User" or "you."

1. Agreement to Terms

By accessing or using the Site or Services, you agree to be bound by these Terms and any additional guidelines or rules posted by EventPay from time to time, which are incorporated by reference.

If you do not agree to these Terms, you must not use the Services.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Services. Certain Events may require users to be 21 years of age or older or otherwise legally eligible, including for alcohol-related Events.

By using the Services, you represent and warrant that you meet all applicable eligibility requirements.

3. Use License

EventPay grants you a limited, non-exclusive, non-transferable license to access and use the Site and Services for personal, non-commercial purposes only. This license does not transfer ownership of any materials.

You may not:

  • Modify, copy, or distribute any materials
  • Use the Services for any commercial purpose or public display
  • Decompile, reverse engineer, or attempt to extract source code
  • Remove proprietary notices
  • Mirror the Site or Services on any other server

This license terminates automatically upon any violation of these Terms. Upon termination, you must cease all use of the Services and destroy any downloaded materials in your possession.

4. Role of EventPay & Event Organizers

EventPay is a technology and payments platform only and does not organize, operate, host, control, or manage Events.

Each Event is independently organized and operated by an Event Organizer, who is solely responsible for:

  • Event operations and execution
  • Vendor selection, pricing, and fulfillment
  • Alcohol service and food safety
  • Health, safety, and security
  • Event cancellation, postponement, or modification

EventPay is not responsible for the acts or omissions of Event Organizers, vendors, sponsors, staff, or other third parties.

Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between EventPay and any Event Organizer.

5. Disclaimer

The Site and Services are provided on an "as is" and "as available" basis. EventPay disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

EventPay does not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times.

6. Limitation of Liability

To the fullest extent permitted by law, EventPay shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profit, or business interruption.

EventPay's total liability for any claim arising out of or relating to the Services shall not exceed the greater of $100 USD or the amount paid by you to EventPay for the applicable Event.

Some jurisdictions do not allow certain limitations, so these limits may not apply to you.

7. Accuracy of Materials

The Site may contain errors or inaccuracies. EventPay does not warrant that any materials are accurate, complete, or current and may update or modify content at any time without notice.

8. Links

The Services may contain links to third-party websites. EventPay is not responsible for the content or practices of any third-party sites, and accessing them is at your own risk.

9. Modifications

EventPay may modify these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

10. Governing Law

  • United States users: governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
  • Canadian users: governed by the laws of the Province of Ontario.

11. Payments, Tokens & Refunds

Tokens are non-transferable, limited-use digital credits valid only for the specific Event for which they are issued. Tokens:

  • Have no cash value
  • Are not legal tender
  • Cannot be exchanged for currency
  • May expire at the conclusion of the applicable Event

All token purchases are final, except where required by law or in cases of confirmed system error or unauthorized transactions.

Refunds related to Event cancellation, postponement, vendor issues, weather, or programming changes are determined solely by the Event Organizer, not EventPay.

12. Assumption of Risk & Release

Attendance at Events involves inherent risks, including crowds, weather, alcohol consumption, food preparation, and third-party conduct.

You voluntarily assume all such risks and release EventPay, Event Organizers, vendors, sponsors, and staff from any claims, whether known or unknown, arising out of your attendance at an Event or use of the Services, except where prohibited by law.

13. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent or deceptive activity
  • Attempt unauthorized access to systems or accounts
  • Upload or transmit malicious code
  • Interfere with the operation or security of the Services

14. SMS Terms

By providing your phone number, you consent to receive transactional and account-related SMS messages, including messages sent using automated dialing systems.

  • Message frequency varies
  • Standard message and data rates may apply
  • Consent is not a condition of purchase
  • You may revoke consent at any time
  • Reply STOP to opt out or HELP for assistance

15. Arbitration & Class Action Waiver (U.S.)

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

The arbitrator shall have exclusive authority to resolve any dispute regarding the interpretation, applicability, or enforceability of this arbitration provision.

You waive any right to participate in a class action, class arbitration, or representative proceeding.

Small claims court matters may proceed individually where permitted.

16. Force Majeure

EventPay shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, weather conditions, power or network outages, labor disputes, governmental actions, public health emergencies, or failures of third-party service providers.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
